Corsearch Product Specific Terms – Trademark Services

These Product Specific Terms apply to Trademark Services provided by Corsearch to the Customer in addition to the other terms contained in the relevant Order Form.  

1. Definitions

The following words and expressions have the following meanings in these Product Specific Terms and any capitalised terms used but not defined herein have the meanings set forth in the Agreement:  

“Trademark Services” are computer-generated and/or analyst-based trademark search and watch services offered through the Corsearch Platform(s).  

2. Onboarding Process 

Customer acknowledges that the provision of the following documents and information is necessary for Corsearch to begin providing the Trademark Services: 

3.1 list of relevant mark(s) in scope; 

3.2 list of User(s) as defined in the Corsearch Master Service Agreement; and 

3.3 any information and/or documentation necessary and reasonably requested by Corsearch to delivering the Services.  

(collectively the “Onboarding Materials”) 

In the event of any delay by the Customer to provide Corsearch with the Onboarding Materials, Corsearch will notify the Customer of the impact of the missing Onboarding Materials and the Customer acknowledges that Corsearch’s ability to fully deliver the Brand Protection Services may be impacted. 

3. Invoicing

Corsearch may elect to invoice from the Corsearch affiliate that fulfills the order for the Services. 

4. Search

Upon signing the relevant Order Form, Customer will provide Corsearch with written instructions specifying the Trademark search order that Corsearch will conduct on behalf of the Customer under this Agreement. On receipt of the written instructions Corsearch will confirm acceptance with an order confirmation sent via email to the Primary Contact Email Address specified on the relevant Order Form. 

5. Watch

Upon signing this Order Form, Customer will provide Corsearch, with a written list of trademarks that Corsearch will watch on behalf of the Customer under this Agreement. This list of trademarks to be watched may be changed by the Primary Customer Contact specified on the relevant Order Form from time-to-time via the online form or via email. When the instructions are initially provided or updated Corsearch will confirm the instructions with a confirmation sent via email to the Primary Contact Email Address on the relevant Order Form. 

6. Generative Naming

Corsearch disclaims ownership of any Intellectual Property Rights created in the Customers use of the generative naming tool, to the extent such rights are created.
