Protecting Your Brand: How to Remove Counterfeits from Facebook

Corsearch

Whether you’re looking to safeguard your established presence on Facebook or just want to prevent intellectual property infringement by third-party sellers and profiles, it’s critical to actively identify and remove counterfeits. In this blog, we outline the tools you can use to protect your brand reputation and prevent consumer confusion.

First, we provide a step-by-step guide to manually removing counterfeits and infringing content on Facebook Marketplace listings, Profiles, Pages, Groups and ads. We then explain the alternative to this resource-draining approach: using Corsearch’s AI-assisted technology and experts to speed up enforcement and significantly reduce the volume of infringement.

Step-by-step guide to removing counterfeits from Facebook manually

Step 1. Identify the type of infringement

Facebook will remove listings and posts that infringe your intellectual property, covering five categories: counterfeits, copyright infringement, brand abuse (which includes other forms of trademark infringement), design infringement, and patent infringement.

Trademark infringement

Trademarks are distinctive elements like words, logos, phrases, designs, or symbols used to identify the origin of goods and services. If someone uses your mark without authorization, it constitutes trademark infringement.

Counterfeits

Counterfeiting is a specific type of trademark infringement where exact copies of registered trademarks on products are used to deceive customers into believing they are buying from the original brand.

A note on lookalikes and replicas – these fakes may not use trademarks but can still be addressed using copyright, design rights, or patents to prevent the erosion of brand equity and consumer trust.

Brand abuse

Brand abuse refers to other types of trademark infringement, such as impersonation profiles, false association on a business page, and unauthorized use of trademarks within adverts.

Copyright infringement

Copyright protects authors and creators of written and multimedia works like books, movies, music, photos, video games, and artwork. Copyright infringement refers to the unauthorized use of protected works.

Counterfeiters often use copyrighted images on their product listings and posts to create an illusion of legitimacy and deceive consumers.

Design right infringement

Design rights offer exclusive legal protection for the physical appearance of products, encompassing 3D shapes, 2D patterns, or logos that identify the brand. While enforcing design rights can be challenging for certain products, they can be effective against lookalikes on marketplaces.

Patent infringement

Patents safeguard inventions, products, or industrial processes, granting the inventor the right to prevent others from using, selling, or importing the invention for up to 20 years. Patent infringement occurs when someone uses the patented invention without permission.

Step 2. Report the infringement

To submit a notice of infringement, you’ll first need to log in to your Facebook account. You’ll then need to complete the relevant Report Form based on the infringement you have identified (as defined above).

Reporting counterfeits

Here's how to report a seller on Facebook for either listing a counterfeit on the Marketplace or posting an external link to a website that offers counterfeits:

  • Start a new Counterfeit Report Form
  • Declare your authorization to enforce
  • Provide your contact information
  • Provide all links to the content infringing your trademark(s)
  • Detail why it is unauthorized.
  • Sign the report using your full name as an electronic signature

Reporting brand abuse

To report other forms of trademark infringement such as impersonation or false association, follow these steps:

  • Start a new Trademark Report Form
  • Declare your authorization to enforce
  • Select ‘I found content which I believe infringes my trademark’
  • Provide your contact information
  • Complete the trademark information section, providing legal documentation (including name of your trademark, registration location, and Nice Classification)

Note: You can strengthen evidence of infringement further by providing information on other relevant trademarks that you own.

Reporting copyright infringement

To report copyright infringements on Facebook, you’ll need to:

  • Start a new Copyright Report Form
  • Declare your authorization to enforce
  • Select ‘I found content which I believe infringes my copyright’
  • Provide your contact information
  • Provide infringement information
  • Provide online evidence of your copyright-protected works (such as your corporate website)

Reporting design infringement

Facebook does not offer a dedicated form to design infringement. To report design infringement:

  • Use either the Trademark Form or Counterfeit Form, adding the Locarno Classification for the category of goods
  • Provide detailed information on how the content infringes on the registered design, pointing to the similarities with your brand’s unique design

Alternatively, you can use the Copyright Report Form to allege that the listing infringes your product artwork.

Reporting patent infringement

Similarly, Facebook does not provide a form for patent infringements, but you can try to remove the listing via one of two avenues:

  • Submit a Counterfeit Report Form, evidencing how the content is infringing your patent
  • Allege trademark infringement and then clarify that the listing is patent infringement when responding to Facebook's reply – you are likely to get a quicker response with this method

Reporting infringements found on Facebook Groups, Pages, and Locations

Alongside Facebook Marketplace, bad actors also use many of Facebook’s other channels to promote counterfeits and infringing content, such as profiles, pages, ads, closed groups, and locations. The process Facebook maintains for enforcing IP rights on any of these channels is the same as above.

When reporting content from a group, you may need to join the group using the same account as the analyst to view the content fully. Otherwise, certain links may appear closed.

Although Facebook generally doesn’t remove locations, you can use the trademark form to report locations by explaining in detail how they are misleading users and damaging your brand’s reputation.

Step 3. Wait for Facebook’s response

Facebook typically takes 1-3 days to remove the reported content. You will receive a ticket via email with a complaint number as confirmation. After processing your request, Facebook will send an email either confirming the removal or explaining the reasons for refusal.

As the steps above highlight, this is a lengthy process that may take time away from other important tasks. And while it is a workable for the odd counterfeit product or other infringement, chances are that your brand is being constantly targeted by bad actors.
